1. Acceptance of Terms
By accessing or using Heirloom ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. By using Heirloom on behalf of a family, you represent that you have the authority to bind the family account to these terms.
2. The Heirloom Service
Heirloom is a family memory preservation platform that enables you to:
- Upload and preserve family memories (text, photos, videos, voice recordings)
- Organize memories in a private family vault
- Use AI to analyze, enrich, and converse about your family history
- Seal important memories for permanent preservation and verification
- Receive weekly digest emails summarizing your family's preserved moments
The Service is currently in beta. Features, pricing, and availability may change as we develop the platform.
3. Accounts & Authentication
- You must provide a valid email address to access your family vault.
- Authentication is handled via magic links: secure, one-time login links sent to your email.
- You are responsible for maintaining access to your email account and the security of your login sessions.
- One email address corresponds to one family vault. You may not share account access with individuals outside your family without understanding the privacy implications.
4. Your Content & Ownership
You Own Your Content
All memories, stories, photos, videos, voice recordings, and other content you upload to Heirloom remain your property. We do not claim ownership of your content.
License to Operate
By uploading content, you grant Heirloom a limited, non-exclusive license to:
- Store and display your content back to you within the Service
- Process your content with AI services (Anthropic, OpenAI) to provide analysis, transcription, and conversational features
- Generate thumbnails, previews, and compressed versions for optimal delivery
- Include content in your weekly digest emails
This license exists solely to operate the Service and terminates when you delete your content or account.
Content Responsibility
You represent that you have the right to upload the content you submit, including any photos, videos, or recordings featuring identifiable individuals. For content featuring others, you should have their consent.
5. Acceptable Use
Heirloom is designed for preserving family memories. You agree not to:
- Upload content that is illegal, harmful, threatening, abusive, or violates others' rights
- Use the Service to store content unrelated to family memory preservation
- Attempt to access other families' vaults or data
- Reverse engineer, scrape, or exploit the Service
- Use automated tools to bulk-upload or extract content
- Interfere with or disrupt the Service or its infrastructure
We reserve the right to remove content or suspend accounts that violate these terms.
6. AI-Powered Features
Heirloom uses third-party AI services to enhance your experience:
- Memory Analysis: AI identifies themes, wisdom, emotional tones, and connections in your uploaded content
- Memory Keeper Conversations: AI enables natural conversations about your family history using your vault data
- Voice Transcription: AI converts audio recordings to searchable text
Important: AI-generated insights, summaries, and conversation responses are provided for informational and reflective purposes only. While we strive for accuracy, AI may occasionally produce incomplete or imperfect results. The AI only knows what has been uploaded to your vault. It does not access external information or fabricate details.
6a. Voice Cloning & Biometric Data
Heirloom's voice preservation feature (Voice Legacy / Sage Speaks) uses ElevenLabs technology to create a voice profile from recordings you upload. This section governs your use of that feature.
Consent is required
By uploading audio of any person for voice cloning, you represent and warrant that:
- The audio is your own voice, OR
- You have explicit, documented permission from the person whose voice is in the recording, OR
- If the person has passed away, you are their next of kin or have documented authorization from their estate or next of kin.
Prohibited uses
You may not use voice cloning to:
- Impersonate any person for fraudulent purposes
- Create content that could reasonably mislead others about what a person actually said
- Generate audio of public figures, celebrities, or any person without their explicit consent
- Produce any audio that could defame, harass, or harm any person
Biometric data handling (GDPR & CCPA)
Voice recordings and derived voice models are classified as biometric data under Article 9 of the GDPR and the CCPA. Heirloom treats this data with the highest level of protection:
- Voice profiles are stored encrypted and linked only to your account
- Voice audio is processed solely to generate your voice profile and is not shared with third parties except ElevenLabs (as the processor) under a Data Processing Agreement
- You can delete any voice profile at any time from your dashboard, which removes it from both Heirloom and ElevenLabs
- If you request full account deletion, all voice data is removed within 30 days
Deceased persons and inheritance
When a Heirloom user dies:
- Voice profiles of the deceased user (their own voice) are preserved as part of their vault and will transfer to the designated Heirloom Heir per the Inheritance Policy
- Voice profiles of deceased family members that the user created remain accessible to the inheritor unless next of kin of the voiced person requests removal
- Any person who is the subject of a voice clone can request removal at any time by contacting voice-removal@tryheirloom.family. We will honor such requests within 30 days.
Right to remove
Any person can request that their voice clone be removed from Heirloom, regardless of who created it. Email us at voice-removal@tryheirloom.family. We will comply within 30 days and notify the vault owner.
Our commitment: Voice cloning is a gift for preserving the voices of the people who matter most to your family. We reject any use that disrespects the dignity of the person whose voice is preserved. If you're ever unsure whether you have the right to clone a particular voice, err on the side of not uploading it.
7. Legacy Sealing
Heirloom offers the ability to "seal" select memories for permanent preservation:
- Sealing creates a permanent record that a specific memory existed at a specific time
- Sealed records are irreversible: once sealed, the record cannot be deleted or modified
- Your content is encrypted and securely stored
- You should only seal memories you intend to preserve permanently
8. Payment & Subscriptions
Heirloom is currently in free beta. When paid plans are introduced:
- We will provide advance notice before any features become paid
- Existing content will not be held hostage. You will always be able to export or download your data
- Pricing details will be clearly communicated before any charges apply
9. Service Availability
- We aim to keep Heirloom available 24/7, but we do not guarantee uninterrupted service
- We may perform maintenance, updates, or changes that temporarily affect availability
- We are not liable for any loss resulting from service interruptions
- As a beta service, features may be added, modified, or removed as we iterate
10. Termination
By You
You may stop using Heirloom at any time. To delete your account and all associated data, contact us at hello@tryheirloom.family. We will process deletion requests within 30 days.
By Us
We may suspend or terminate your access if you violate these terms. In such cases, we will make reasonable efforts to notify you and allow you to export your data, unless the violation involves illegal activity.
Effect of Termination
Upon termination, your vault data will be deleted from our systems within 30 days, except for sealed legacy records (which are permanent by design) and any data we are legally required to retain.
10a. Inheritance & What Happens When You Die
Heirloom is a legacy platform. We've thought carefully about what happens to your vault after you're gone.
The Heirloom Heir
Every Heirloom user can designate a Heirloom Heir from within their dashboard settings. This is the person who will receive full access to your vault after your death. You may designate a spouse, child, or other trusted family member. You may change your designated Heir at any time.
Notification of death
To transfer a vault to the designated Heir, the Heir must contact us at inheritance@tryheirloom.family and provide one of the following:
- A certified death certificate (preferred)
- An obituary plus government-issued ID of the Heir
- A court order designating the Heir as executor
We will verify the submission in good faith and complete the transfer within 14 days.
What the Heir receives
- Full read and export access to the vault (all moments, photos, voice, memoir chapters, family tree, heritage map)
- The ability to continue adding memories to the vault in your memory
- Voice profiles the deceased user created — subject to the Voice Cloning consent rules above
- The designation of a new Heirloom Heir for the next generation
If no Heir is designated
If a deceased user had not designated an Heir, the vault enters a Grace Period of 2 years during which any verified immediate family member (spouse, children, parents, siblings) may claim inheritance rights. After 2 years, the vault is permanently archived and access requires a court order.
Dignity provisions
- Sage will never initiate a conversation with the family of a deceased user unless the Heir explicitly enables that feature
- Voice profiles of the deceased will never be used in automated marketing or promotional content
- The Heir may request that Sage display a quiet memorial banner, a full archive mode (read-only), or continued active preservation mode
11. Limitation of Liability
To the maximum extent permitted by law:
- Heirloom is provided "as is" and "as available" without warranties of any kind
- We do not guarantee that AI-generated content will be accurate, complete, or error-free
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid to Heirloom in the 12 months preceding any claim (or $100 if using the free tier)
12. Indemnification
You agree to indemnify and hold harmless Heirloom, its founders, and service providers from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.
13. Governing Law
These terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of California.
14. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you via email or a prominent notice on the site at least 30 days before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated terms.
